Terms and conditions
These terms apply to purchases of Prestige and subscriptions to Agency. They describe what each plan includes, how long the service lasts and your rights.
Version dated 13 October 2026 · English translation for information. The French version is authoritative.
1. Seller and scope
Memolith is published by Maxime Wuillaume, sole trader (entrepreneur individuel, EI), trading as SENDIX, 2 bis place de la République, 55500 Ligny-en-Barrois, France. SIREN: 801 868 431. SIRET: 801 868 431 00033. Registered with the Bar-le-Duc Trade and Companies Register (RCS). Contact: memolith@sendix.fr — +33 6 78 09 53 29. VAT is not applicable under Article 293 B of the French General Tax Code.
These terms apply to paid plans ordered on Memolith by a consumer or business. The customer confirms they have capacity to enter into the contract and, if acting for an organization, authority to bind it. Plan details shown before payment supplement these terms.
Opening an account and using the free Discovery plan remain subject to the service rules below and do not require a purchase.
2. Service and plans
Memolith lets an organizer create an event page and share a link or QR code so guests can add photos and voice messages. The organizer can view, manage and export the memories from their account. An event’s collection period can last up to seven days.
- Discovery — free: one event at a time, 25 photos, 10 voice messages and hosting for 3 months after the event ends. Deleting that event lets you create another.
- Prestige — €39 incl. tax per event: one-time payment, 2,000 photos, 300 voice messages up to 5 minutes each, all 5 templates and hosting for 2 years after the event ends.
- Agency — €149 incl. tax per year: annual subscription to Prestige features for up to 10 new events per subscription year. Each covered event includes 2,000 photos, 300 voice messages up to 5 minutes each, all 5 templates and hosting for 2 years after that event ends.
Each image is limited to 10 MB and each upload to 10 images. Limits apply separately to each event; they are maximum capacities, not required usage.
The service requires an internet connection, a recent browser and—when recording voice—a device with a microphone that the user permits the browser to access. The customer is responsible for checking their equipment before the event.
3. Order, prices and payment
Prices are those displayed in euros, including applicable tax, on the order page. SENDIX benefits from the French VAT exemption for small businesses. The server validates the price; it cannot be changed in the browser.
Before checkout, the customer checks the chosen plan, accepts these terms, acknowledges that the order requires payment and separately asks for the service to start immediately. Stripe processes card payments. SENDIX does not receive the full card number.
The order is final when Stripe confirms payment. Memolith then activates the plan on the selected event or adds a credit to the account if no event was selected. Failed or abandoned payment does not grant paid features. Receipts issued by Stripe remain available in the billing portal linked from the Memolith account.
4. Term and cancellation of Agency
Each paid subscription year includes 10 new events. A slot is consumed when an Agency event is created or an existing event is first assigned to Agency. The quota resets at annual renewal, with no rollover of unused slots. Previous events do not consume the new quota and keep their hosting period. Deleting an event does not restore its slot.
Agency begins when the first payment is confirmed and lasts one year. It automatically renews for successive one-year periods at the renewal price communicated to the customer, unless cancelled before the renewal date.
The customer may cancel at any time using “Manage subscription and invoices” in their Memolith account. Stripe records the cancellation, which takes effect at the end of the paid period. That period is not refunded, subject to the right of withdrawal and other mandatory consumer rights.
To apply Agency to an event, its collection dates must fall within a paid subscription period. Once covered, an event keeps its two years of hosting after it ends, even if the subscription is not renewed. After the subscription expires, no new event can be added without renewal.
Consumer customers receive the information required by law about renewal and how to prevent it. Any price change for a future subscription period is announced before it takes effect.
5. Consumer right of withdrawal
A consumer may withdraw from the contract within 14 days of its conclusion without giving a reason. Send notice to memolith@sendix.fr, using the sample form below or any clear statement sent before the period ends.
If a consumer expressly asks the service to start before the 14-day period ends and then withdraws, they may owe an amount proportionate to the service supplied up to the withdrawal request. If the service is fully performed before the period ends, the right of withdrawal ends only after the consumer has first expressly agreed and acknowledged that consequence.
SENDIX refunds amounts due no later than 14 days after receiving notice of withdrawal, using the same payment method unless the consumer expressly agrees to another method at no cost.
To SENDIX — Maxime Wuillaume, 2 bis place de la République, 55500 Ligny-en-Barrois, France — memolith@sendix.fr.
I notify you that I withdraw from the following Memolith plan: [Prestige / Agency], ordered on [date]. Name: [name]. Account email: [email]. Postal address: [address]. Date: [date]. Signature only if sent on paper.
6. Legal guarantee of conformity
A consumer may rely on the French statutory guarantee of conformity if a defect appears during the plan’s supply period: until 3 months after the event for Discovery, and until 2 years after the event for Prestige or each event covered by Agency. During that period, the consumer must show that a defect exists but does not have to prove when it appeared.
SENDIX must provide updates needed to keep the service in conformity during the relevant period. The consumer may request conformity to be restored without undue delay, cost or major inconvenience.
The consumer may receive a price reduction or end the contract, with reimbursement in return for giving up the service, if SENDIX refuses to restore conformity, unjustifiably delays, charges for it, causes major inconvenience or the defect remains after an unsuccessful attempt. The consumer may act immediately where the defect is sufficiently serious. Any unavailability needed to restore conformity suspends the remaining guarantee period.
These rights arise under Articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code. A professional who deliberately obstructs this guarantee may face the civil fine under Article L. 242-18-1. A consumer may also rely on the French Civil Code warranty for hidden defects under Articles 1641 to 1649 for two years from discovering the defect; it can result in a price reduction or reimbursement in return for giving up the service.
To make a warranty claim, contact memolith@sendix.fr with your account, the event and the issue. Statutory guarantees apply in addition to any commercial guarantee.
7. Content, access and responsibility
The customer chooses event details and the people with whom they share the link or QR code. The customer must protect login details, check that they have the rights needed for submitted photos, voices, names and other content, and explain the intended use to guests. Content that is unlawful, deceptive, hateful, violent, infringes privacy or a third party’s rights, or breaches copyright is prohibited.
Customers and contributors keep their rights to their content. For as long as the service needs it, they authorize SENDIX to technically host, copy, convert, display and make the content available to authorized organizers. This does not allow SENDIX to use memories for advertising.
SENDIX may remove clearly unlawful content, suspend compromised access or temporarily limit a feature for security or maintenance. Except in an emergency or where required by law, SENDIX will inform the customer of a measure that affects their service for an extended period.
The customer must download the memories they wish to keep before hosting ends. Media may be deleted after expiry. If a customer deletes an event, access ends and its content may be permanently deleted. Residual technical backups are rotated according to the periods described in the privacy policy.
SENDIX is responsible for its obligations as required by law. It is not responsible for impossibility caused by the customer, an unrelated third party or force majeure, except where mandatory law says otherwise. Nothing in these terms limits statutory guarantees or mandatory consumer rights.
8. Complaints, mediation and applicable law
Send any complaint first in writing to memolith@sendix.fr or SENDIX, 2 bis place de la République, 55500 Ligny-en-Barrois, France, so the parties can try to find an amicable solution.
After an unresolved written complaint, a consumer customer may contact the following mediator free of charge: SMP, Alteritae 5 rue Salvaing 12000 RODEZ, https://www.mediateur-consommation-smp.fr.
These terms are governed by French law. A consumer may bring a claim before a court with jurisdiction under the applicable rules. For business customers, disputes that cannot be settled amicably are submitted to the courts with jurisdiction over SENDIX’s registered office, subject to mandatory rules.
SENDIX may change these terms for future orders or to reflect legal or technical changes. The version accepted at the time of an order is stored with that order. Material changes affecting an active subscription will be communicated appropriately.
